Commercial Litigation

In the Commercial Litigation field, our firm prides itself on having exceptional and extensive experience in litigating in the Magistrate’s Court, High Court and Constitutional Court.  Our experience includes work pertaining to the following:

o   Delictual, contractual and unjustified enrichment claims, with an emphasis on financial transactions;

o   Forensic investigations;

o   Commercial claims with an emphasis on the financial services industry and general banking law, including litigation pertaining to FAIS, fraud (especially cheque fraud and related banker’s liability), credit law, money laundering as well as interest, overdrafts and most other aspects of retail banking;

o   Constitutional litigation;

o   Commercial claims dealing with insurance related matters (mostly personal injury claims; short term insurance policies and motor vehicle collisions);

o   Commercial claims dealing with mining related issues (statutory; delictually and contractually); and

o   Commercial claims pertaining to Company law.
